Love it when a landlord flat out lies to you. We were told that they are having marital issues. Come to find out on here there was a default noice sent out in June of this year and today 8/20/09 I get a 'resident of property subject to forclosure sale' notice in my mail box(glad they are locked boxes or the landlords father who lives next door would have swiped it-he's a winner but that's another story). It says that 20 days after the notice the property will be sold at foreclosure sale. Nice, she tries to make us feel sorry for her while she drives a BMW and he has a boat that they are obviously using the rent money to pay for instead of the mortgage on this house. Good thing for me that a coworker of my husbands has a place that they need to rent out. At least I have a place to go. The landlords have another thing coming if they think they get to keep my 1500.00 deposit as I will take them to small claims court and sue them and most certainly will have them both served the papers on their respective jobs.

Julie, nowhere in the new law does it state that you have to pay rent. It only addresses the number of days that you can occupy the house.

I'm the Julie that posted a previous comment. I have an update on our situation. The Trustee Sale for our current address was yesterday (8/27/09.) It was bought by a company that "flips" houses (buys houses at action for less than market value, guts them, rebuilds and the re-sells for a nice profit.)Same day as the sale, we were contacted by agent with an offer of $7,000.00 Cash-For-Keys. Offer effective until Sept. 9th. I said, "What if we just stay here for 90 days, and then move." He replied, "You could, but you would have to pay us rent (probably a HUGE rent) and then you'd just have to move anyway." So, what I'm saying is, even with the new law, there is big-time pressure to move out, especially if a foreclosed house is bought by these companies that are making profits by "house-flipping." And, in answer to the person that wanted to know if there was a law anywhere that says a LL needs to disclose if their house is in foreclosure-There is none!! My former LL (former as of yesterday, had the nerve to come by telling me he was still working on the loan modification and wanted me to give him a check for September's rent. I said we didn't owe rent yet, and that I was going to wait to see what would happen after the 27th. He was pissed, but he left empty-handed. He knew it was too late, but still wanted to rip us off again!! My advice to any of you that have a Trustee-Sale notice, contact the company that is company listed on the notice. They are the ones that you can request Trustee Sale info on the property you are renting. Don't take the word of your LL. They lied to get you and your money, and they will continue to lie and get your money right up to the bitter end. Information is power, and the companies handling the Trustee Sale will give you info. We just got a trutee's sale notice today, to take place on 9/16. Property manager (who happens to be friends with the owner) says it is a mistake, there was also a notice served to another one of his properties, and owner is in the middle of "reorgnanization". I'm just not buying it.

This is so scary!We just found out our house is in default and the landlord said she is just "refinancing". There is no law that says she has to tell us in Nevada also? Or is that just Cali?

There is no law that says a landlord must tell a prospective or current tenant that the property they are renting out is subject to foreclosure...and there should be!!! We were lied to by the person we rented from. We had just moved from a rental that was foreclosed (that landlord happily took $2000.00 a month from us while he ignored house payments.)We told our new landlord our story, and he commiserated with us, took our deposit and rent, and four days after we moved in, I was happily hanging curtains and I stopped to open the door to check for mail, and there was a Trustee Sale notice tapped to my door!!! We renters need a law that will force these landlords to be honest!!!
