we just moved into a house...a week after we finished moving the constable showed up looking for the owners..(told to us thankfully by the neighbors) we looked into it and found out that 3 days before our lease actually began that a breach was filed against the house. tonight i came home to find a lady taking pictures, i asked what are you doing and she said are you the owner...i said no we just moved in renting, she then said you might want to look into this, so my question is..am i still required to pay rent since this started prior to my lease date? and i specifically asked them prior to signing if they were in any chance of a foreclosure. the owners of course said no. i dont know who to believe or do.

James from Lifestyle Realestate took our rent and never bothered to tell us that the house was in foreclosure. When we found out, he played dumb. We wrote a letter and stopped paying rent. We were then unlawfully evicted. By the time we were served by a constable, it was pretty much too late. The stupid Judge did not care and evicted us. We were homeless and did not even get an opportunity to tell our side. Dont take anyones legal advice like we did. Stall on rent and get out.

Basically George is saying take the rent your not paying and retain yourself a lawyer. So yeah have the ownwer force himself to serve a notice to move or pay in, 5days is it. Well here's the deal, you got scammed by the owners they knew but they needed some pocket money before they walk out of there deal. We renters get the short end of the stick and our asses out on the street.. Yeah lets take them to small claims court what ever delay. Well believe this believe in yourself screw the rent its been broken get out and find another place to rent. Did I mention Las vegas is #2 of most foreclosure in the united states. Hey heres a thought lenders ask the renters if they would like to take over the owners mortgage and you can stay in the house to own!!!! Call it a second chance for the lenders to keep getting there money!!!!!!!!!!! from the original owners defaulting on there payments..

I would contact the Neighborhood Justice Center or a lawyer for advise but would not pay the rent until the situation was resolved by the court. Not paying the rent will force the owner to serve you with a 5 day notice to pay or move. When that happens request a hearing before a judge and be prepared by having all the notices posted against the property with you when you get before the Judge. Make sure that when your in court that you request that proceedings be recorded so you can have a transcript of what happens should you need to appeal. Most of the time the summary eviction proceedings are not recorded because that is an extra cost. The 40 to 50 you will give the court reporter could save you thousands and I have found that the Judge seems to make better decisions when the proceedings are being recorded. Good Luck In the future it would be best to deal with a property manager instead of an individual owner. The property manager has a license to loose and has duties under the law that must be performed.
