Comment: My house is now in foreclosure and the only way i found out was by opening a piece of mail that was addressed to her but sent to my house instead. My landlord still has not contacted me about it and my home is now in default |

First off, it is illegal to read or open anyones mail that is not addressed to you. I understand it has your address on it, but its easy to see that the letter did not have YOUR name on it. Do not open any more mail that is addressed to your landlord, it is 100% illegal. Also, I wouldn't mention to your landlord or to a judge (if it goes that far) that you were reading your landlords mail.
Secondly, if you are planning on renting another house after your current house gets foreclosed on, MAKE SURE that you add a clause or make your landlord clarify a clause in your lease agreement that is specifically about foreclosure. My lease agreement has a paragraph that I suggested to my landlord to protect both of us. It states that if my landlord goes behind on a payment OR plans to sell the house, she must notify me 3 months in advance. If while I'm living there, she decides to sell the house: 1- she's breaking the lease and will need to pay 2 months penalty to me. 2- She must give me 3 months notice before listing it.
If she's going into foreclosure:
1- She again is breaking my lease agreement and owes me 2 months rent.
2- She must give me 3 months notice if she is letting the house go back to the bank.
Hey, If I broke the lease to go buy a house, she would make me pay the 2 months rent penalty- this way its even.
She agreed to it and that way each party (the landlord and the renter) are protected. The clause also states that if she knowingly goes into default on her home and neglects to tell me, She will owe me 2 months rent plus my security deposit, PLUS the cost of moving. I will then have 30 days to vacate the premises.
Every situation is different, every landlord is different, but I urge you to add a foreclosure clause in your next lease agreement so yo
