Comment: Our landlord is in default and is claiming that he lives at our house in order to get a loan mod with his lender. He does not live at our place, instead has his own separate primary residence. Is this fraudulent? If so, are we complicit in this fraud if we say nothing to the lender? |

I had already come to the same conclusion, and in fact contacted the lender, JP Morgan, to let them know about the situation. I can't believe how difficult they made it to report fraud against their own company. I faxed a letter and the lease to the lender on 5/19/09 and haven't heard a word from them. I have a feeling the banks don't want to know about this kind of fraud because they don't need anymore foreclosed properties on their hands. But at least I did my part to report it.
I already know the LL is in default and hasn't made a payment since we moved in 8 months ago. The only thing I can say is, what a sleaze ball! Posted By Maxine from California on May 27, 2009, 3:38 pm You are definitely at risk of being charged with "lender fraud" when you lie to the lender. Don't do it. You may want to start looking for another place to live, however, or at least check rentalforeclosure.com to see if there's a notice of default. Your landlord may not be making his payment.
