I rented a property through Southwest Real Estate, Joe Garcia. He has been very arrogant and difficult to deal with. My lease has an added provision that states: Owner states that any loan(s) against the subject property are paid current and shall remain so. Yesterday I had my second visit from a Wells Fargo Contracted inspector ans was told that the home is in foreclosure. Last month when the inspector came by I questioned my property management company and they said there is no NOD so whoever came by is lying. They also said they spoke with the owner and he said everything is current, that someone must be trying to pull a scam and they are lying. I called the property manager while the inspector was here and he came over and argued with the inspector for a while and basically admitted that it looks like the owner is not making the payments. Last month I requested proof that the mortgage is being paid and was told yesterday that the owner acknowledges the clause in the lease but that does not mean that he needs to prove that it is paid current. I was questioning the property manager and he basically said that if the rent is not paid he is going to do an eviction as soon as he can. I also found out that a NOD was filed 9-16-09 so the management company and homeowner are both lying. I am wondering what my rights are in this situation. Also my lease was signed in February and we moved in for March 1st. I am trying to find out when the last payment was made, but from other people I spoke with, they have not made a payment since May and had their second inspection so it looks like this owner signed the lease and has not made a payment since after my second month in the property. Do I have any rights and recourse? Is there the potential to bring action or complaint against the property management company, and the licensed Realtor that knows the payment is not being made in accordance with the lease and is threatening to evict me and my family of four children and a wife?

http://www.leg.state.nv.us/NRS/NRS-118A.html#NRS118ASec355 - NRS 118A.350 Effective Oct 1, 2009 a tenant may choose to terminate their lease early, WITHOUT a 30 day notice with no liability after the seller has received Notice of Default & Agreement to Sell.

Kudos to you for adding that to the lease. I'm looking at needing a lease in Vegas and am learning what I need to do to protect my family.

Call the recordersy offices and they will tell you when the last payment was made
