Nevada Foreclosure Information
A foreclosure in Nevada generally takes 120 days. The first step in the process is the notice of default. Usually 90 days after the notice of default is filed the lender begins preparing the notice of sale. The notice of sale must be published for 3 consecutive weeks prior to the actual sale. Generally 1 of 2 things happens at the sale, either the property sells to a new owner or the property reverts back to the bank. Once the sale is completed the new owner, be it the lender or someone else, can begin the process of vacating the property. Changes brought on by Assembly Bill 140 go into effect on October 1st, 2009. One of the most important changes for renters in Nevada is that a tenant can terminate their lease and move out of the property once the notice of sale is filed. Once a foreclosure is completed the new owner is required to give tenants at least 90 days notice to vacate in most cases and in some cases they are required to honor the remainder of the tenant's lease. This is federal law and to qualify the tenant must be, and stay, current with their rent.
